Special Needs Trusts

Special Needs Trusts are incredibly beneficial for individuals with disabilities or others who are receiving or who may receive governmental benefits under means-tested programs (e.g., Medicaid, Special Assistance, SSI).  These trusts allow them to receive or benefit from assets in such a way that does not disrupt those benefits.  The terms of these trusts, timing and means of funding the trusts, the nature of the trust assets, and the individual’s needs all must be considered when establishing the trust or as part of an overall estate plan.  These details are best addressed with an attorney who is familiar with special needs trusts during a conversation that is specifically focused on your particular circumstances.
